Protective and Precautionary Measures in the CCII. The Conference in Vicenza.

High-Profile Event on March 28th and 29th at the Historic Venue of Palazzo delle Opere Sociali in Vicenza, with a Conference Dedicated to Insolvency Procedure Professionals. Gobid Group will sponsor the training event organized by Fallimenti e Società – Observatory on Corporate and Insolvency Law of the Triveneto Region, in collaboration with the Association of Chartered Accountants and Accounting Experts of Vicenza.

A major event for professionals in the legal-economic sector, bringing together leading experts in insolvency law, judges, and academics for an in-depth discussion on the new application scenarios introduced by the Code of Business Crisis and Insolvency (CCII), with a special focus on the sensitive topic of protective and precautionary measures. A valuable opportunity for continuing education and exchange for bankruptcy trustees, judicial commissioners, lawyers, accountants, and all professionals involved in insolvency proceedings and corporate restructuring processes.

The aim is to analyze key areas of the legal-economic landscape, marked by increasing dynamism, and to delve into significant rulings in order to foster a stimulating reflection on a legal-economic field considered “among the most complex, urgent, and—especially today—widely pervasive.” These are some of the main objectives of the Fallimenti e Società Observatory, which positions itself as a true “meeting place” through the organization of seminars, round tables, and conferences, all geared toward dialogue and professional growth.

Focus on Measures within the Framework of the CCII

The first day of the conference, Friday, March 28th, will be dedicated to the theoretical and practical framework of protective and precautionary measures—central tools in the procedures introduced by the Code of Business Crisis and Insolvency (CCII).

Following the institutional greetings, Dr. Gianfranco Peracin (Chartered Accountant and member of the Executive Board of Fallimenti e Società) will open the proceedings and coordinate the presentations.

Dr. Alida Paluchowski, former President of the Bankruptcy Division of the Court of Milan, will explain the definitions and contents of the measures. She will be followed by Dr. Andrea Zuliani, Judge at the Court of Cassation, who will discuss the requirements for standing and the areas of application of such measures in negotiated settlements, regulatory instruments, and judicial liquidation.

Professor Sido Bonfatti (University of Modena and Reggio Emilia) will then explore the topic of contractual self-protection, with particular reference to banks, financial intermediaries, and credit assignees.

The day will conclude with Professor Stefania Pacchi (University of Siena), who will address the complex topic of the duration, extension, and continuity of protective measures during the transition between different procedures.

Operational Insights and Procedural Aspects

The second day, Saturday, March 29th, chaired by Dr. Giuseppe Bozza, former President of the Court of Vicenza, will be entirely dedicated to an in-depth examination of protective and precautionary measures in the context of composition with creditors and restructuring procedures, as well as the procedural aspects related to their granting, confirmation, and revocation.

The session will open with an analysis of typical and atypical measures in composition proceedings by Professor Laura Baccaglini (University of Trento) and Professor Francesco De Santis (University of Salerno), with a focus on the new second paragraph of Article 54 of the CCII.

This will be followed by a presentation from Professor Ilaria Pagni (University of Florence), who will address the application of such measures prior to filing for composition, in restructuring plans, and in simplified composition procedures.

Professor Giuliana Scognamiglio (Sapienza University of Rome) will then explore the issue of the initial interaction between the debtor and the judicial authority, illustrating the obligations, penalties, and the role of the expert and creditors.

The event will conclude with a presentation by Professor Fabrizio Di Marzio (University of Chieti-Pescara), focusing on the procedure for the granting and revocation of measures within the context of composition with creditors.
