The Avellino Short Master Concludes

The Avellino Short Master offered a high-level educational program consisting of eleven sessions, concluding on June 14th. It was organized by the Order of Chartered Accountants and Accounting Experts together with the Avellino Bar Association and in collaboration with the University of Salerno. This valuable initiative focused on the central theme of Business Crisis and Insolvency, where Gobid Group had the honor of participating as the main sponsor, reaffirming its commitment to training and updating professionals in judicial sales. Participation in the short master allowed enrollment in the Register of subjects appointed by the Judicial Authority for Management and Control Functions in Procedures governed by the Crisis and Insolvency Code. Additionally, the course was valid for the fulfillment of training obligations pursuant to art. 4, paragraph 5, letters b) and d) of DM 202/2014.

The 2024 edition was a real success, achieving a “sold out” status by reaching the maximum number of participants. Distinguished speakers from the academic, legal, and judicial worlds participated in the sessions. The event was sponsored by Ance Avellino, the IrpiniaSannio Chamber of Commerce, and Confindustria Avellino.

The focus on the evolution and current state of the business crisis discipline officially opened the Short Master on February 9th. Among the topics discussed on the first day were insolvency and over-indebtedness, up to article 3 of the Crisis Code on the new culture of prevention and adequate organizational structures. These topics were discussed by Dr. Pasquale Russolillo, Delegate Judge of the Avellino Court, Dr. Marcella Caradonna, Adjunct Professor at the Catholic University of the Sacred Heart of Milan and Chartered Accountant, Prof. Stefania Pacchi, former Full Professor of Commercial Law at the University of Siena – Carlos 3 UCM Excellence Chair – Banco Santander, and Prof. Avv. Sergio Menchini, Full Professor of Civil Procedural Law at the University of Pisa and Partner at Harpalis.

On February 16th and 22nd, the central theme was the negotiated resolution of the crisis, with particular attention to the national single platform, simplified arrangements, and early crisis detection signals. Speakers included Prof. Avv. Claudio Cecchella, Full Professor of Civil Procedural Law at the University of Pisa, Avv. Anna Pappalardo, PhD in Business Crisis at the University of Pisa, Dr. Sara Serretiello, Delegate Judge of the Salerno Court, and Dr. Tommaso Nigro, Chartered Accountant specializing in Business Crisis.

The regulation tools of the crisis and insolvency were covered in the sessions held on March 8th, March 22nd, and April 5th. Specific topics included the initiation of CCII proceedings, procedural principles and conditions, and the certified recovery plan, continuing with agreements and the restructuring plan, concluding with procedures for over-indebtedness composition and controlled liquidation. These timely topics were addressed by Prof. Vincenzo Donativi, Full Professor of Commercial Law at LUM-Giuseppe Degennaro University and LUISS “Guido Carli” University, Dr. Giorgio Jachia, President of the Bankruptcy/Concursal Section of the Salerno Court, Prof. Raffaele D’Alessio, Full Professor of Business Economics at the University of Salerno and Chartered Accountant, Prof. Luca Sensini, Associate Professor of Business Economics at the University of Salerno and Chartered Accountant, Prof. Avv. Nicola Rocco di Torrepadula, Full Professor of Commercial Law at the University of Salerno, Dr. Pasquale Russolillo, Delegate Judge of the Avellino Court, and Dr. Luigi Pagliuca, Delegate Judge of the Verona Court.

Judicial liquidation was the focus of the seventh session, featuring Prof. Avv. Giovanni Capo, Full Professor of Commercial Law at the University of Salerno, and Prof. Avv. Bruno Meoli, Full Professor of Comparative Legal Systems at the University of Salerno. The course continued with compulsory and administrative liquidation on May 3rd, with speakers Prof. Avv. Niccolò Abriani, Full Professor of Commercial Law at the University of Florence, and Prof. Avv. Lorenzo Benedetti, Senior Researcher in Commercial Law and Lecturer on Crisis Management at the University of Pisa.

The topic of over-indebtedness was covered in the session on May 10th by Dr. Silvia Bianchi, President of the Specialized Business Section at the Venice Court, and Dr. Caterina Carrer, Chartered Accountant specializing in Business Crisis, while the termination of the procedure within judicial liquidation was discussed by Prof. Stefania Pacchi, former Full Professor of Commercial Law at the University of Siena – Carlos 3 UCM Excellence Chair – Banco Santander, and Dr. Walter Palermo, Adjunct Professor of Auditing at the University of Sannio and Chartered Accountant.

The series of training sessions concluded on June 14th with discussions on fiscal and criminal provisions (Titles IV and IX of the CCII). The speakers were Dr. Giulio Andreani, Crisis Tax Referent for PWC Tax & Legal and Chartered Accountant, and criminal lawyer Avv. Luigi Petrillo.
