After the official greetings from the President of the Verbania Court, Gianni Macchioni, the President of ODCEC Verbania, Stefano Noro, the President of the Verbania Bar Association, Paolo Ricci, and the President of ACM, Roberta Zorloni, the discussion will get underway.
The March 21 program will focus on possible solutions for negotiated settlements, including contractual, planned, and composition-based approaches, as presented by Milanese lawyer Edoardo Staunovo Polacco. He will also address the selection of different pathways based on the objectives pursued.
The day will continue with an intervention by Filippo D’Aquino, Judge of the Court of Cassation, who will analyze the shift away from the “myth of majority consent” as a coercive element for dissenting creditors, outlining the evolution of concordato preventivo from the Best Creditor’s Interest principle to the requirement that the plan must not be detrimental.
Laura De Simone, President of the Second Civil Section of the Milan Court, will explore the emergence of compulsory compositions within liquidazione coatta amministrativa (L.C.A.) and their incorporation into the Business Crisis and Insolvency Code. Dr. De Simone will place particular emphasis on the need for transparency, comprehensive information, and judicial oversight.
